CLE Mediation – From the Perspective of Mediator and Advocate Part II

  • 07:45 AM
  • HCBA Conference Center, 100 Pearl street, 2nd floor (East Tower), Hartford
  • 860-525-8106

This is a two hour program, which follows upon the initial HCBA CLE program on Mediation, presented on March 15, 2018.  Although this is a follow up to that initial program, attendance at the March 15 program is by no means a prerequisite for attending and benefiting from this somewhat more advanced offering.

In this advanced program you will have the opportunity to gain deeper insights into the “fine art” of Mediation, with presentations from two active mediation practitioners as well as from a strong advocate of the mediation tool – Bankruptcy Judge James J. Tancredi.

Among the subjects covered will be:

Judge Tancredi – Best pre-mediation practices; Confidentiality in mediation proceedings; Mediator immunity; compelled mediation; Other innovations.

David Shaiken – Ethics in mediation; “Telling the truth”; The importance of listening, and how to do it; Dealing with deadlock; Mediator follow-through if no settlement achieved.

Thomas Gugliotti – The differences in settling a Sec. 523 or Sec. 727 claim; What the advocates need to consider; What the Mediator should do to prepare.

These presentations will benefit both Mediators and attorneys who appear for clients in Mediation proceedings.
