Strategies and Techniques useful in The Art of Depositions
Taking and defending depositions is as much an art as anything we do in litigation. How you approach each deposition can vary greatly depending on a large number of variables. Choosing the right strategy or technique to accomplish your goals and address difficult situations that arise can make a bad witness for you into a great one, or take down a key witness for your opponent. In this presentation we will go over commonalities as to all depositions and ways to address them, such as different strategies for preparing your witness, educating yourself, dealing with difficult witnesses, handling difficult attorneys, and knowing when not to ask a question. Though by no means exhaustive, the arsenal of techniques will be a good review for some and new for others.
